There are no clear guidelines in the legislation on how to register a musical group. However, the registration of his name, as well as the creative heritage can be formalized.
Instructions
Step 1
Register with the tax authorities as an individual entrepreneur (if you are a member of a musical group) or LLC (if you are its producer). Only private entrepreneurs have the right to register the name of their company as a trademark. In addition to the name of the collective, you can also develop its logo, which will be reproduced not only on albums, but also on posters and other print products. By the way, the concert image of a group, stage design, and choreography can be registered as a trademark.
Step 2
Prepare all documents (certificate of registration of the organization indicating the name of the group, a copy of your passport, charter), a sketch of the logo, etc. and send them to Rospatent for registration of the trademark. If such a name does not appear anywhere, get documents confirming that you are the owner.
Step 3
You can register your band name by giving the same name to the first album or one of the songs. In this case, it will be protected by copyright law, and its use and reproduction without your permission (for example, on posters) will be prohibited. Officially, copyright may not be registered. But if you do not want the name of your group to be used by unknown persons for mercenary purposes, contact the Russian Copyright Society (Department of registration of rights).
Step 4
Think of a collective pseudonym as the name of the group, which will also be protected by the Law of the Russian Federation "On Copyright and Related Rights." In addition, you can conclude a written agreement between the authors and performers of songs on the implementation of joint creative, concert and other activities, clearly delimiting all rights and obligations in it. Subsequently, if disagreements arise between the group members, this document will help to defend the interests of each of them in court.
